How to be Arrested for Paying Your Ticket!?

The title of this blog sounds funny but it is true. Again today we were called to help a client who paid his ticket but was facing a driver’s license suspension for driving while their license was invalid or suspended. This time, he was lucky. He could have been arrested! So how could this happen? How could he be in trouble for paying his ticket? Let me explain:
If you have ever been issued a traffic ticket and decided that you should just pay it rather than fight it, then you join the millions of people throughout the years who have put themselves at risk of losing their license or being arrested! In Texas, certain violations can cause you to lose your license to become invalid or suspended. If you are caught driving while your license is suspended or invalid, you are subject to suspension of driving privileges and/or subject to arrest and prosecution.
For example, you are pulled over for speeding and no valid auto insurance. You know you are guilty of both offenses and decide to just pay rather than fight to protect your record. A year goes by and you think you are in the clear. Then, you are pulled over again for speeding and the officer states that your license was suspended and he has choice, issue you a ticket for driving while license invalid (the class C version) or arrest you for the same thing but file it as a class B misdemeanor. If you are lucky, you just get the first one. What no one told you was that by paying your no insurance ticket you caused a conviction to be put on your driving record. A conviction for no insurance causes a surcharge to be issued against your license. For whatever reason, you never received the notice of the surcharge in the mail from the Texas Department of Public Safety and your failure to pay the surcharge caused your license to become invalid.
This exact scenario happens all the time in Texas and most of the time, the client can plead that he never knew that would happen just by paying the ticket. Therefore, that is why we say that paying your ticket could get you arrested. If you have never been arrested, just ask someone who has. It is not fun and can cause so many problems for you. Do not just pay your ticket, you may be arrested for it!
